Apply for Legal Representation in Criminal Court

If you’ve been charged with a crime and cannot afford an attorney, you may be eligible for free legal defense from a Public Defender.

How to Apply

Step 1.Complete a Financial Affidavit

Complete the form to the best of your ability. The more information you give us, the better we will be able to assist you.

If you receive public assistance (such as SNAP or Medicaid), please bring your identification card with you, if possible.

Step 2.Submit Your Form

Once completed, you can get it to us by:

  • Saving and Emailing Heather Hughes at PubDef-Intake@co.ulster.ny.us; or
  • By calling (845) 340-3646 or (845) 340-3232, option 3, to schedule an appointment; or
  • Bringing the printed form with you and visit our office Monday through Friday, 9 AM–5 PM, at 280 Wall Street, Second Floor, Kingston (across from the County Courthouse)

Step 3.Meet with Us

You will meet with a member of the Public Defender’s office who will review your form and ask additional questions.

Step 4.Review and Determination

Applications are often reviewed the same day they are submitted. After the review, you will be advised whether you are eligible for a free attorney. 

  • If you are eligible for counsel and there is no conflict that would prevent the PD’s office from representing you, you will be advised of your attorney’s name and be given their contact information at your appointment.

  • If you are eligible and the PD cannot represent you due to a legal conflict, we will inform the court of your eligibility, and the court will assign someone to represent you.

  • If it is determined that you are not eligible, you are entitled to know the reason and to ask for a review of that determination. You will be given information on that process at your appointment.
