Tobacco License Application

The “Ulster County Tobacco Licensing and Reduced Youth Exposure to Tobacco Law” requires all Tobacco Retail Establishments to obtain a Tobacco Retail License from Ulster County Department of Health (UCDOH) and to display the license prominently at a location where the Tobacco Products are sold that it is readily visible to customers.

This Permit is required in addition to the New York State Retail Registration Certificate to sell tobacco products, which is required by State Law.

Instructions

Step 1.New Business? Check Your Location

Ulster County Law prohibits new licenses from being granted to a tobacco retailer located within 1000' of any K-12 school in Ulster County. If you are applying for a new license, check the map(PDF, 6MB) to be sure your location is outside of a school zone.

Step 2.Get Your NYS Retail Tobacco License

Get a current, valid copy of your Retail Dealer Certificate of Registration from the NYS Department of Taxation and Finance.

Step 3.Submit Application

Review the cover letter and then complete your application.

Submit your application, along with a copy of your Retail Dealer Certificate, in person or by mail to:

Step 4.License Issued

If your facility meets the permitting criteria, the Department of Health will issue a license to your business for the sale of retail tobacco vape products.

Step 5.Display Your License

Before selling any tobacco or vape products, make sure to display your license where the tobacco products are sold. The license should be readily visible to customers.

Step 6.Inspection 1: Adult Check

The Department of Health will perform a first inspection.  This inspection will review all necessary licenses, and the types of products being sold at the facility.  All applicable signage and product placement will be reviewed to ensure compliance with state regulations.

Step 7.Inspection 2: Underage Purchase Attempt

An underage worker (under the supervision of the inspector) will attempt to purchase a tobacco product from your store.  This inspection is done to ensure compliance with all NYS age restrictions for the consumption of tobacco and vapor products.
